A man accused of being a felon in possession of a firearm has pleaded guilty.
David Roberts pleaded guilty Friday after Judge John Jarvey dismissed his requests to throw out statements he made to officers as well as the gun they found in a search of his truck.
Roberts was driving on Interstate 80 when he spotted a sign indicating a drug checkpoint ahead. He and his passenger pulled off into the next rest stop, at Bettendorf. That is actually where drug agents were stationed.
Agents approached Roberts and his passenger. After a drug dog indicated a weak alert on the truck, it was searched. Roberts consented to the search of his suitcase, documents say, where officials found a gun.
No drugs were found in the truck.
Roberts argued the search was not voluntary. He did not feel free to refuse, his attorney said.
Prosecutors argued that the search was voluntary.
A sentencing date has not yet been set.
