Judge dismisses TouchPlay lawsuit

   DES MOINES, Iowa — A Polk County judge has dismissed a California company's lawsuit over TouchPlay machines now banned in Iowa.

   District Judge Donna Paulsen threw out all claims by Diamond Games Enterprises Inc. of Chatsworth, Calif.

   The company, which manufactured TouchPlay games, had argued that Iowa officials breached their contract when the Legislature banned the games in May 2006.

   Paulsen found that the contract between Diamond Games Enterprises and the Iowa Lottery allowed the lottery to terminate their agreement without advance notice because of legislative action.

   Last month, the attorney general's office said it has reached various settlements in lawsuits filed by TouchPlay businesses. Officials say those settlements have accounted for about 80 percent of the 6,700 TouchPlay machines operated under the TouchPlay program.
